(hereinafter collectively and indistinctly referred to as "FM", "we", "our" or "us") is an international reference centre in Gynaecology, Obstetrics and Assisted Reproduction, belonging to the International Assisted Reproduction Group owned by Futurelife, A.S., with registered office at Na příkopě 1047/26, Nové Město, 110, Prague, Czech Republic ID No.: 026 25 067 (hereinafter "Futurelife").

We provide personalised care with professionals working as a team, based on a strong human bond between doctor and patient. All specialists coordinate in order to offer couples a service that combines the latest technology with the most advanced diagnostic and treatment methods.

We attach great importance to the privacy of individuals, whether visitors to our website https://fertilitymadrid.com/ (hereinafter the "website") or any other affected parties who provide us with information through it, whose data are processed by FM as part of the provision of services (hereinafter and collectively "you" or the "user", and in plural form "you" or the "users").

In this regard, FM undertakes to process your data in accordance with the personal data protection regulations applicable and in force at all times. Specifically, FM will comply with the provisions laid down in current Spanish legislation, as well as those of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC, and any other relevant regulations in force.

Accordingly, FM informs you of its Privacy Policy, in order to make users aware of the processing of their data, as well as of the fundamental principles on personal data protection applied. Certain services provided, or that may be provided in the future on the website, may however contain specific terms of use with particular provisions on personal data protection that shall prevail over this Privacy Policy.

1. Who is responsible for the processing?

The data controller is the Futurelife´s operational entity - FL Service, s.r.o., ID no. 04213190, with registered office at Na Poříčí 1047/26, Nové Město, 110 00 Prague 1, Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague, file number C 243578.

2. What are the users’ data protection rights?

Users may exercise the following rights:

  • Right to request access to personal data: you may ask FM whether we are processing your data and, if so, access them.

  • Right to rectification: to have inaccurate data corrected or incomplete data completed.

  • Right to erasure of your data.

  • Right to restriction of processing: in this case, we will only keep them for the exercise or defence of legal claims.

  • Right to object to processing: FM will cease to process your personal data, except when they must continue to be processed for legitimate reasons or for the exercise or defence of possible claims.

  • Right to data portability: if you want your data to be processed by another controller, FM will facilitate the transfer of your data to the new controller.

  • Right not to be subject to a decision based solely on automated processing of your personal data.

If you have given consent for a specific purpose, you may withdraw it at any time, without affecting the lawfulness of processing based on consent prior to its withdrawal.

If you exercise your right of erasure, all personal data linked to your account, as well as any information and content in your profile, will be deleted. Should you exercise this right in relation to data necessary for FM to provide services through the website, FM will be obliged to terminate its relationship with you, proceeding to deregister you without any entitlement to claim.

To exercise your rights, users must send written communication to FM’s registered office or to the email address indicated in section 1 of this Privacy Policy, in both cases including a photocopy of your ID card or an equivalent identity document.

3. How can you file a complaint with the Spanish Data Protection Agency?

Complaint before the Supervisory Authority: If you believe FM is improperly handling your personal data, you may lodge a complaint with FM’s DPO or with the relevant Supervisory Authority. In Spain, this is the Spanish Data Protection Agency (AEPD).

4. In what cases do we collect personal data about you and what type of data?

For the purposes of this Privacy Policy, “personal data” means any information that identifies you or may be used to identify you, such as your name, address, telephone number or email address.

If you decide to provide us with your personal data, FM and any Futurelife entity may have access to the data included in each form you complete or those you provide through the different email accounts FM makes available for contacting us.

These data are processed when you interact with FM and our representatives; when you participate or ask to be considered for participation in activities related to FM, such as service provision or online surveys about our services; when you interact with the website and are asked to provide personal data, as described in this Privacy Policy and our Cookies Policy; when you register on our website or use certain features without registering, such as participating in our interactive services.

5. How do we use users’ personal data?

FM informs users that the personal data provided and collected will be recorded in FM’s Record of Processing Activities and used for the following purposes:

  • Booking a first appointment.

  • Enquiries relating to your specific case.

  • Providing your testimony.

  • Questions about financing our services.

  • Requesting an appointment.

  • Providing our services, in accordance with the Legal Notice, where applicable, between FM and each user.

  • Responding to users’ queries or requests for information.

  • Keeping users informed through notifications/newsletters via email, WhatsApp and/or other electronic means, mainly about our services, brands belonging to the Fertility Madrid group, activities, projects, updates and new website features.

  • Use or provision of services, where prior registration is required, in accordance with the website’s general Terms of Use and the particular conditions of specific services.

We will not sell or disclose to third parties any personal information you provide on our website that may directly or indirectly identify you.

8. Where are your personal data processed?

FM will not transfer personal data outside the European Economic Area (EEA). If such transfers were to take place, FM would do so in compliance with applicable data protection laws.

9. How do we protect your personal data?

FM maintains the security levels required by current legislation and has put in place all technical means available to prevent the loss, misuse, alteration, unauthorised access and theft of data provided by the user through the website.

FM will take appropriate technical and organisational measures, both at the design stage and during data processing itself, to preserve security and prevent unauthorised processing. The professionals working at FM who may be involved in providing services to the user are committed not to disclose or misuse the information they access. The information provided by the user will in any case be treated as confidential and may not be used for purposes other than those related to managing requests and services contracted with FM.

We therefore undertake not to disclose or reveal information about the user’s intentions, reasons for seeking advice or the duration of their relationship with FM.

12. Social media

FM is present on some of the main social networks, where it acts as controller regarding data published by FM.

FM will process data on each social network according to the rules established by that platform. Therefore, unless otherwise indicated by FM, we may inform followers on the relevant social network about our activities, events and other related topics, including customer service, through the channels provided by each network.

FM will not extract personal data from social networks unless you expressly give us your consent.

13. Special categories of personal data

We will only collect and process your personal data relating to health, race or ethnic origin, genetic data, biometric data for the exclusive purpose of identifying a natural person, sex life or sexual orientation if you have explicitly provided them to us.

Other categories of special personal data, such as political opinions, religious or philosophical beliefs or trade union membership, will neither be collected nor processed.

14. Child use policy

This website is not designed for or directed at children under eighteen (18) years of age without parental or legal guardian authorisation. We do not knowingly collect information from such individuals.

18. Amendments and validity of our Privacy Policy

If at any time we decide to use personal data in a manner different from that stated at the time of collection, we will inform you by email, provided we have your address. At that time, you will be given the option to authorise other uses or disclosures of the personal data you provided to us before the amendment of our Privacy Policy.

Should any clause of this Privacy Policy be annulled or considered null and void, the remaining conditions shall not be affected and will remain valid and in force in accordance with the applicable legislation.
